GEORGIA High court overturns appeal ATLANTA -- In reversing an appeal decision Monday, the Georgia Supreme Court reinstated an Augusta man's conviction and 25-year sentence imposed for participating in a homicide. The court ruled Monday that a judge was incorrect when he decided Charles Jefferson Mitchell was entitled to a new trial in Richmond County Superior Court. Mr. Mitchell and his brother, Michael Steven Mitchell, were convicted on voluntary manslaughter and weapon charges and sentenced to 25 years in prison for the Oct. 2, 1994, killing of Danny Hucks, 22. According to trial testimony, Mr. Hucks and Michael Mitchell had been feuding for some time when they agreed to fight it out at some sand dunes off New McDuffie Road. Michael Mitchell shot Mr. Hucks in the back and then beat him with a stick before firing a final and fatal shotgun blast at Mr. Hucks' face, according to witnesses, including Kyle Spell, who pleaded guilty to a reduced charge of aggravated assault and received a five-year prison sentence.
