First act of injustice was to give Kyle Spell a plea of Aggravated Assault and 5 years in prison. It was after all, his gun...his truck...and his words..."point Danny out to me, I'll take care of him". Today he is a "free man" living in Florida.
Secondly, Michael Stephen Mitchell was sentenced to life plus 5 years. The Georgia Supreme Court on a technicality ruled that he couldn't be convicted of the two crimes he was convicted of, and ruled he had to be sentenced to the "lesser crime" reducing his sentence to 20+5 years. C'mon people...don't you know these killers have rights too?? Moreso than we do.
And here is Charles Jefferson Mitchell....the one who that night purchased the shot gun shells on the way to the "fist fight" Partook in the beating of Danny Hucks and drove the car to the dam. He feels he was treated very poorly in court. Treated less fairly than Danny? I think not. On October 2, 1994, Jeff thought himself to be Judge and Jury over Danny Hucks' life. Thank god the jury he had was more lenient. He was probably going to be released in November 2004 on parole, because that's how the great state of Georgia works....but instead US Judge Dudley Bowen ordered his release and his conviction vacated, which would give him no criminal record...enable him to even purchase a gun and maybe once again...take someone's life. It seems the Judge felt he deserved an appeal, a second chance...funny...noone gave Danny Hucks one. They simply ended his life. Danny Craig, District Attorney in Augusta Georgia is retrying him now for murder, again. Hopefully the good citizens of Augusta will do the right thing...even when a Judge cannot...or simply will not. Upon Judge Bowen being asked...did he feel Mr. Mitchell was guilty of murder he replied "that was not the point" What Judge Bowen, is the point??
